EURO COURT RULES IN DECISION ON LUTSENKO - UPDATE 2

The European Court of Human Rights in Strasbourg has today declared Yuri Lutsenko's detention unlawful and politically motivated. According to Lutsenko's legal representative, Valentyna Telychenko, the court ruled in Lutsenko's favour under Articles 5 (Human Rights Convention) and 18 (Political Persecution). She added that the decision was proof that politically motivated persecutions are taking place in Ukraine.

Yuri Lutsenko has written to President Yanukovych and to the Procurator General, Viktor Pshonka, demanding implementation of the European Court's ruling, and for all those involved in his arrest and court case to be prosecuted. He says that, if his letter is ignored, it will show a continuation of political repression and lack of regard for the rule of law.

However, the latest news is that the Ukrainian Government is to appeal against the verdict, within the three months allowed before the verdict becomes final. The Ministry of Justice says it is preparing the documentation. It will be interesting to see the reasoning against such a comprehensive condemnation by the European Court.
